5 Year short fall for ILR

Post by umer80 » Thu Oct 16, 2014 8:13 pm

Hi,
I seem to be in a fix here and I am hoping that someone can help me out here.

My Tier 1 (General) visa started on 15-Jan-2011 but I arrived in UK on 14-May-2011 (after about 4 months)
I applied for my extension and new visa now expires on 7-Feb-2016 which means that I will be 3 months and 7 days short on my continuous 5 years. Also, with the new rule I can't apply for another extension after Apr-2015.
This means that I will not be able to complete my 5 years of continuous stay with the current extension and I think that I can't apply for the second extension.
Is there any way out of it?

thanks,
Umer

Hi,

Thanks for the reply. Is it possible? I thought I could only apply for the extension only once there are 28 days left in the expiry of existing visa.

Careful, even for ILR, it's 28 days before your qualifying period which is 5 years..
And not 28 days before current visa expiry as that may be taking you in up to 7-8 years in UK

Thanks,
What NKS was trying to say is that you can apply for your ILR upto 28 days before you complete your qualifying period i.e. 5 years.

In case you extend your visa before Apr 2015 and get it extended for 3 years you do not need to wait until 28 days till the visa expires. You can apply once you complete 5 years.
