Claming child benefit whilst child was away

Hi all, hope you can help,

I am a British national, My wife is Indian, she was granted 2 year FLR after our application for ILR was refused, but she had spend most part of the 2 year FLR period back in India due to medical reasons which meant our two year old child also had to stay with her. The child was born in the UK in March 2012, they left the UK in Dec 2012 and came back in June 2014 so the child was away for 17 months. We are about to apply for another FLR fir my wife next month, I have been claiming CB just on my name since he was born. Would this affect our application for FLR?

any input will be greatly appreciated.

You should have notified HMRC and CB should have been suspended 12 weeks after the child left the UK.

thanks, I was completely unaware of it until someone mentioned it to me few days ago. is it too late to notify hmrc? will I be fined?

Not sure if it is too late, but you will most probably need to pay back the over payment.

Did the child receive medical treatment in India for a condition that started in the UK?

no, the medical was for the wife, not the child.
