ILR - Calculating 28 days

Hi,
My Visa will expires on 01.10.2012

When I used the Date Calculator and subtract 28 days, it gives me : 03.09.2012

Can I apply on the 03.09.2012 or it has to be after 03.09.2012?

First, did you arrive on 1 Oct, 2007? Because it's 28 days before your 5 years, not 28 days before your visa expiration. Your visa could expire before or after that time.

If you did, then 3 Sept is 28 days before and should be fine but if you want a buffer to be sure, do it the next day. It's not the only day you can apply, but the first day of the window of opportunity and you may want to avoid any doubt.

Devb: if you entered UK within 90 days of getting EC, you can apply for ILR 28 days before the 5th anniversary of your EC (entry clearance).

Hi Both,
Thanks for the response. In my case I am within the 90 days so I can take the date of Visa.

My question is can I apply on the 28th day (is it legally OK) or should it be after 28th day?

Is it "on or After 28 days" or "After 28 days"?

Devb: it’s 28 days before the 5th anniversary of your EC date.

When did you get the entry clearance ?

Hi everyone, just want to clarify something. My visa expires on June 19, 2012. I entered on July 1, so technically I have time to apply counting 28 days from 1 of July. For personal reasons I'd prefer to apply earlier, in May. Could I do that? Count from 19 June instead of 1 July?

If you entered UK within 90 days of EC Stamping then you can apply up to 28 days before 5th anniversary of EC date.

Visa Valid Until : 01.10.2012
EC date : 01.10.2007
Entered to UK : 05.10.2007

Can I book an appointment for a PEO exactly on 03.09.2012?
(28th day before 01.10.2012)

Or should I book a date after 03.09.2012?

Devb: you can apply on or after Monday, 3 September 2012.

calculating 28 days before 10 years period for ILR

I entered UK 20th Nov. 2004. and I applied ILR today Saturday, 25th Oct. 2014. It will reach to Home Office Monday 27th Oct 2014.
Am I right to apply the date 25th Oct. 2014. When Home Office will count, what day I applied the application, The posting date or the receiving date.

Your application post date is considered as application date.

In case of application sent thru courier it is receiving date which is considered as application date.
