Tier 1 extension only for Main applicant and ILR

Hi

In my case, i might have to go for an extension before ILR as I am short by 4 days

So my question is can i go for extension for just myself and not for my wife as my wife joined me in UK in November 2011 and hence she has to be in uk for 2 yrs before she can apply for ILR

Summary -
Initial grant - 20 april 10
Arrival in UK - 16 july 10 ( 86 days after initial grant )
Current leave expiring - 16 april 2015

If I apply for an extension say now, and my wife still stays on her current leave which expires on 16th april 2015
can i then apply for ILR for both of us around 5th April 2015 ??

Any help will be highly appreciated.

Yes. However, you can apply from 28 days before 20 April 2015. So how are you short?

Brcause my current leave does not cover 5 year period
It ends 4 days before completetion of 5 years

Sry i did read and what i uderstand from ur post is.... That i can apply 28 days before 20th april. But mu doubt is that i do not have a visa till 20th

Hi Amber,

I have a situation that

1. My initial visa granted(29/12/09) - landed uk on 24 march 10(85 days/ before 90 days rule) and my second extension was granted from(31/01/2013 - 30/01/2015)
2.Calculating continuous period: if I apply on 15 December 2014 as did they calculated from the date of application?,My visa valid till january 15(Can I exclude current expiry and say I'm applying under 28 days threshold according to initial visa granted)

3.And my wife and son dependant visa valid from(31/01/2013 - 30/01/15) as rules say she can't apply ILR(visa granted after 2012) under 2 years stay, she has to wait for 5 years for ILR is that same rules apply to my son as well or he can apply ILR with me,pleas help me I'm really confused your help will be much appreciated

4.And one more can we all apply together even if we are applying in different categories.

Hi Amber/anyone,

Can you please help me out with this query I'm planning apply ILR on end of December my son who is born abroad and he is in uk from March 2013,Once I get my ILR can he apply for ILR regardless of qualifying period my wife is not applying ILR she is applying under Tier1 dependant extension if so what form needed to be filled for my son any help will be much appreciated thanks in advance.

No. Son cannot apply for ILR (319J(e)(iv)) before his mother.

Hi,

I am on Tier-1 general VISA which is expiring on 10 February 2016. But because of the new rule I have to extend it before 05 April 2015. My family VISA is valid till 10 February 2016. So, do I also need to extend my family VISA before 05 April 2015 or I would be able to extend their VISA after 05 April 2015?

In short, I want to know whether the new rule of getting extension is valid to main applicants or also for their dependents.
My family needs to complete 5 yrs for the ILR as we applied for their VISA when new rules for family ILR were placed.

If the Tier 1 (General) holder can extend, or is granted ILR under PBS, then their PBS dependants may continue to extend their leave (319C, 319H), with period granted not exceeding the main applicant's (319D).

generally as practice stands, you should be able to apply now, and have your qualifying period considered from the date of the issue of your first tier 1 leave (so applying up to 28 days before that which is already now)

if it were me and all things equal i would apply in january nonetheless, the above would still apply, it woudl still be rfrom teh date of initial grant

your son cannot apply until both parents either have or are being granted ILR. for him it's not the length of residency but simply fact that not both parents are yet settled
