10 year ILR application.Passport expired .Please help

Hi,

I am going to post my ILR application on basis of 10 year residency.

I have all the passports with me with all the visas and travelling history on it and i will send these along the application.

Although from Dec 2013 to March 2014 my passport was expired. I did not renewed my passport as just i didnt need it during that time.

Obviously i did not travel or anything, Will home office ask for any proof during this period. Will i be ok sending off the application with all the passports that i have now.

Please help.

Please some one guide. Please as i am applying tomorrow.

You have to renew your passport first then apply for ILR otherwise HO may object that your passport is expired.

yes the passport is renewed. I have the current valid passport with me. All i want to know is that the time during which my passport was expired from DEC 2013 to MARCH 2014, will there be any issue or i need to send any additional documents. I didnt travel during that time anyway

Are you able to demonstrate that while your passport expired, you were still in the country and with a valid visa? Not sure about whether it would have any problems or not but if you are able to demonstrate above then it may add into your plus points.

It shouldn't be any problem but for save side include utility bill or bank statement for that period.

Yes i do have the valid leave to remain and i was in country during my expired passport duration as i cant travel with a expired passport anyway.

Also if home office takes into account that i was outside for that 4 months than even the total number of days outside uk will still fall under the number of days allowed by home office to be outside uk in 10 years.

Also my new passport also have the old expired passport number verifying that it was that passport held by me before this new one.

you have raised an interesting point. my passport was also expired for a period of around 4 months for which period i did not need to travel.

i applied on 21st aug and waiting to hear back on my set(lr) application

PS: never really thought about it to be honest

Visa is issued to a person. Not to the passport. You should be fine.

One more question.

I am just sending the following docs. please let me know if i have everything that is the requirement in this case.

1.SET(LR) form
2.All the passports
3. BRP
4.Life in uk test pass certificate
5.Degree from UK

Thats all really..isnt it.

Is there any need to attach any payslips or bank statements at all.

Dear Friends,

My 10 years of long residency have been completed but my case is in UT due to the rejection of Tier 4 visa. Now I want to file my ILR application. Can you please tell me what should I do now.
1. Should I withdraw my appeal first then apply for ILR? or
2. Can I apply for ILR without withdrawal of my appeal.
