We have exactly the same timeline from appeal hearing date, appeal allowed date to fee refund date. Hopefully I should get my visa this week as well.

Hi Guys ,

Its good that we share our appeal timelines in a single thread rather than create new ones. My timeline is as follows:

Visa Catagory: ILR (10 years long residence)
Application Made: 29th June 2013
Refusal letter: 17 Dec 2013
Appeal Hearing : 16 Sep 2014
Appeal Allowed : 1 October 2014
Fee refunded : 17th October 2014
Visa issue : still waiting

Kid82, Many many congratulations for your receiving brp card. My appeal was allowed 2nd September 2014, fee refunded 24th September. I should receive my brp card now then. I can not wait for this anymore!!!

Reason for my refusal was that i was out of the country for 191 days (5 year period) instead of 180. I had sent proofs i.e. Medical certificates and marriage certificate for the delays. Caseworker did not consider them and refused the visa but the judge did in the hearing and the appeal was allowed.

I am waiting for a long time after appeal allowed, don't know what to do :/

I have contacted with local MP. She is going to contact with HO next week. I have sent reminder letter to HO already.

Can you provide guidance on how the days are calculated is it January to December or from the time you receive your visa
I received my visa in July 2013 and entered in the same month so would it be calculated from July to July

Hi Kid82 , I had exactly the same issue with my ILR application . Can you let me know whether the judge allowed the appeal for the home office to reconsider your application on the basis of exceptional circumstances and to exercise use of discretion on the calculation of continuous residence ?

Secondly , did you receive your visa from Sheffield or Liverpool centre ?

Could let me know your timelines and what you have done after hearing please.
I have sent letter to HM twice, called twice, contacted through MP three times. Still response that it is under reconsideration :(

First of all I would like to thanks all the valuable members of this forum for there timely help and expert suggestions

I would like to have an advice in my case.
I had applied for ILR on the basis of HSMP (2) years + Tier(1) General (3) qualified 5 years route.
At two different instances I traveled back home under unavoidable circumstances related my health.
08th january 2009 till 25th april 2009 ............................ 106 days due to foot drop (paralysis)and diabetes
11th may 2010 till 04th october 2010............................. 145 days due to severe uvities in left eye.
I had supplied all the medical certificates to Home Office. But the case worker did not consider and refused my visa.
I was allowed to appeal for the same.
My appeal got adjourned and rescheduled in march 2015.
Now, I had again complications with my left eye and this time I had eye surgery with in few weeks time in UK

1.I would like to ask the experts here that what is suppose to Home Office that compelling reason to loose vision or get paralyzed .

2.should I include my latest medical certificates from UK ? While appearing for appeal (as I am going for Oral appeal).

3. I submitted the old bundle already, should I send my latest medical certificates now.

You are well within 180 days that you can stay out of the country per year why have they refused your application
145 days in 2010 and 106 in 2009

Alhamdulillah . I have received my ILR on Friday . I had applied for ILR on 10 years basis. Got refused due to prolonged absence . HO didn't accept my compelling reasons for absence due to circumstances beyond my control which took my 8 months . Judge accepted them and allowed the appeal .

I wish everyone the very best and it is the will of the almighty . Anyone needs a good ( the really good ) solicitor . Plz pm me
