ILR Continious Residency TIER 1 Offshore project

Post by vivekprd » Thu Nov 06, 2014 9:37 am

Hi All
I'm on a tier 1 general visa which expires on May 2016 , which completes my 5 years Tier-1 extension. However currently I've been out of country for around 5 months for an offshore project working for a UK based company and this is likely to continue for another 6 months . I'm a contractor but I get paid in UK account . Will this affect my continuous residency criteria . The company has agreed to give me paperwork to prove that I was out of country for their work purpose.
Any advice or suggestions would be greatly appreciated.

Many thanks
Vivek

Indefinite leave to remain: calculating continuous period in UK wrote:Any time spent working off shore on the UK continental shelf, beyond the 12 mile zone defined as UK territorial waters does not count toward the continuous qualifying period for ILR, for example on ships or oil rigs. You must count this as an absence from the UK.

Absences must be connected to the applicant’s sponsored or permitted employment, or the
permitted economic activity being carried out in the UK.

As long as an letter from employer is provided, then it should be fine,

Thanks Argus but does this not contradict with
"Any time spent working off shore on the UK continental shelf, beyond the 12 mile zone defined as UK territorial waters does not count toward the continuous qualifying period for ILR, for example on ships or oil rigs. You must count this as an absence from the UK."
