Looks like they are trying to go as far as they can go and not violate EU directives or step on human rights.

It maybe the same type of measure which was abolished few years in which non eu national apply certificate of marriage from ukba before marrying.

Except they can't deny someone a right to marry unless they detect (or reasonably suspect) fraud. With the COA scam they had going, no Certificate of Approval, no marriage, period. That was much more blatant denial of human rights as plenty of people who are not citizens should be able to enter into a legal marriage without restraint to citizenship. It's no surprise that it quickly became a profit before finally being shut down. The UK government literally held peoples futures lives together in their hands.
