It means that the home office has applied for permission to appeal the tribunal. They are trying to challenge the tribunal's decision to allow your husbands appeal.

It will take the FTT usually a few weeks to decide whether permission to appeal should be granted. If they refuse permission to appeal then the UKBA can renew the permission to appeal application to the Upper Tribunal.

If either the First Tier or the Upper Tier grant permission to appeal then it can take a few months for a new hearing date to be set.

Permission to appeal will only be granted if there is an arguable material error of law in the decision of the FTT

Do you have a solicitor? If PTA is granted it may be worth getting one if you don't have one already.

Sorry I have just re-read your original post and can see that the application has been made to the Upper Tribunal already.

Have you previously had notice of an application to the First Tier Tribunal?

great, good luck with the appeal. You should find out the reasons why they wanted to stop the appeal. It could be a big clue/help to what the probliem was in the first place.

My question is about immigration please help

Post by MrQuintal » Sat Mar 03, 2012 9:49 am

My question is about immigration so what's happen was I applied for a uk fiance visa to get married in London to my fiance she is from Peru. The UKBA said no to the visa so I appealed to the first tier tribunal and had to go to a court hearing on the 18th jan 2012. The judge then ruled in my favour I then received a determination letter Appeal is Allowed. Then on the 31st of jan 2012 I received a email saying Your appeal against your UK visa refusal has been allowed by a UK Immigration Judge.
If you still wish to obtain an UK visa, please do the following

Please provide your passport to the Embassy/High Commission in your home country along with a copy of this e-mail within 4 weeks. They will send your passport to New York and it will be returned directly to them for collection by you at no additional charge.

So I sent the passport off on the 3rd Feb 2012.

> Once your passport is received, your visa should be processed within ten working days and you will be notified by e-mail when your visa has been printed.

> Kind Regards,

> New York Visa Team
> UK Border Agency
> British Consulate General,

Now I have received a letter on the on the 2nd of march 2012 saying to the appellant and respondent.
Notice of Receipt
This is to acknowledge receipt on the 28th February 2012 of an application for permission to appeal to the Upper Tribunal.
You will be informed of the result in writing.
So can they do this to me after the appeal was allowed?

But what I don't get is why did they ask for the passport to be sent off for the visa if there intention was to appeal to the upper tribunal anyway?

probably a case of two different departments in UKBA not communicating with each other.

I got the same letter that the home office made appeal for permission by tribunal in 11 February. I haven't hear any result in writing. Does any of you know how long it take to reply. This is out of order.
