Help! recieved a One stop warning, What does this mean?

Post by kezza84 » Sun Feb 16, 2014 8:54 pm

Hi,

I hope someone can help apologies in advance if this gets long winded. I arrived in the UK at the age of 15 in 2000 I came her to live with my maternal mother. I have since remained and have not gone back to my birth country, during these years as a minor I was of the impression that my mother had all my immigration matters in hand. In all honesty I was non the wiser or educated about being a residence/illegal but then I wonder which minor would have been clued up on immigration issues?

At the age of 21 I was then told by my mother what needed to be done, she already had her ILR and so did my younger sister. I applied a fair few times I paid a lawyer who sent the incorrect amount so my application was returned he then passed away to which I wasn't informed, I then made another application in 2010 at this time I was with my children's father who is a member of the armed forces.

My application was rejected 6 months later, I asked my lawyer to return asking for a reconsideration now 2 years later I receive a one stop warning letter my daughter is now 6 and my youngest is 1.5yr old they both have British passports. I am worried because I have no idea what this means, I have asked the solicitor who just kept saying it will be fine but will not explain what the process is.

My daughter is diagnosed with Autism and attends a specialist school. She also has her statement of special needs and solely relies on me and is very attached to me I am worried I will be forced to leave my children but we also have no family in my birth country they all live here and USA.

Any ideas what the one stop warning is? Does this mean I am in line for deportation?

Please advise

Thanks in advance

You need to regularise your stay, whether there are avenues as your partner is in the armed forces, as the spouse of a British person or under FLR(FP) and exception 1. Your solicitor should be advising you.

A one stop notice is issued under section 120 of the Nationality, Asylum and immigration act 2002.

It allows you to states all the reasons why you should be allowed to stay in the UK, so all matter can be considered, and in the event of refusal, you will have one appeal.

In you circumstances, i believe you have a very decent prospect of securing at least a 30 months leave to remain.

Thank you for your help, they requested more information last week which I submitted via my solicitor. I am hoping this is a positive outcome so I can focus on my family rather than continue living in uncertainty.

Kind regards

Hi, I submitted all the paper work I could find including letters for my daughter from the Dr, school and Council. They then replied 2 weeks later asking for further information and utility bills in both our names dated 2yrs or more. I sent everything I could find and now waiting, waiting, waiting. I was not asked to sign on or report, I did bio metrics years ago this is now pending since 2011!!
