Dependant Maintenance Requirements

Dear Gurus and all!

49.  If you are applying as the family member of a Tier 1 (Entrepreneur) migrant you cannot use the same funds to meet the maintenance requirement that the Tier 1 (Entrepreneur) used to meet the attributes requirement (appendix A of the Immigration Rules).

Can someone kindly elaborate the above clause, which is mentioned under PBS policy guidance regarding Dependant Maintenance Requirements.

the main applicant obviously shows his personal maintenance along with the investment funds to fulfill his requirement.

the dependent has to show their funds in addition to that.........it sounds quite simple

is there anything in specific that is confusing you......

I have been into this country for more than 6 years and now I am bringing my wife here. I am planning to show a bank statement with the total amount of £3000, put consecutively for 4 months. So, only that single statement is enough with regards to dependant maintenance. Please correct me if I'm wrong.

45.  If the Tier 1 Migrant is outside the United Kingdom or has been present in the United Kingdom
for less than 12 months, you must show that you, the Tier 1 Migrant, or (for children) your other
parent who is also legally present in the United Kingdom have at least £1890 to support you; this
is in addition to any funds the Tier 1 Migrant needs to prove they have enough money to support
themselves.

46.  If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, you must have
£630 to support yourself.

I believe your minimum requirement was £900 when you applied for your visa

if that is so then yes remaining amount of £2100 are funds in addition to that and are more than enough for one dependent.

I take your answer as yes.

I was confused when it says 'same fund'. I thought I have to show two bank statements, one for me and the other for my wife.

Moreover, it talks about

Tier 1 (Entrepreneur) used to meet the attributes requirement (appendix A of the Immigration Rules).

. Can you please shed on this one as well.

if you read the last sentence in section 45. as mentioned above

"this is in addition to any funds the Tier 1 Migrant needs to prove they have enough money to support
themselves."

it is very clearly addressed that the minimum maintenance you showed (£900 ie) cannot be used for dependents maintenance..

as I said your statement should be in additon to £900+(dependents required funds)

if there is still confusion

then just maintain your £3000 you dont need anything more for maintenance funds (for one dependent)
