Hi,
I successfully applied for a stamp4 eu4fam 5 years ago and have been resident in the state since then. However my recent application for a permanent residence failed.

I am planning to reapply again for a stamp4 eufam.

How long does an EU citizen have to be self employed here before the spouse can apply for the stamp4 residence permit?

This is what it says in the explanatory leaflet.
If the EU citizen is self-employed, copies of the following documents should be provided:
• Agreed Tax Assessment from the Revenue Commissioner for the last financial year (if applicable) OR Letter of Registration
for Self-Assessment (Income Tax) from the Revenue Commissioner
• Receipts issued for sales or services in the last six months
• Bank statements of the business for the last six months
• Companies Registration Office certificates (if applicable)
So, if a person only has a few weeks of sales receipts or bank records will that be enough?

Evidence of 6 months of the EU citizen being self employed in the State is necessary for an EU1 application. Why was the EU3 application refused?

Thanks for you reply.

The EU3 application was refused due to insufficient proof that the EU Citizen was residing for a 5 year period in the state. ie: No continuous record of employment, study etc.

A refusal for insufficient evidence of residing is exactly that. It means that there was not evidence of 'residing' in the State for 5 years which means utility bills and letter from landlords etc.
A refusal regarding working and studying etc would be a refusal based on non-exercise of rights in the State.
These are two different types of refusal.

Either way, you have a good chance of an EU1 approval i'm sure if the EU citizen is now working and residing in the State

Thank you once again.

The form says that one should supply :

Current letter from employer setting out terms, conditions and hours of employment
AND/OR Signed contract of employment
Two recent payslips
Most recent P60 or Tax Credit Certificate .

Are weekly payslips or fortnightly payslips fine?
What impact will it have on the application If a P60 is not available?

Payslips can be weekly or even monthly, it doesnt matter. It's just evidence of the EU citizens ongoing employment. Regarding the P60, if you do not have a P60, you would need a tax credit certificate or a P21 from revenue.

A friend who wants to apply for stamp4 wants to know if part time work is considered. If so what is the minimum amount of hours and rate of pay.

A part time job is sufficient, even a job of 10 hours a week but less than that could be see as marginal and may be refused for insufficient exercise of rights
