Domestic violence and EEA3/4 application

Hi Everyone,
URGENTLY NEED HELP
A EEA National is married to a NON-EEA NATIONAL. Due to Domestice Violence they are separated not divorced. NON-EEA2 is going to expire in June 2015. Is there anything THEY could do?
If he applies for EEA 3/4, will there be a question about this?
Do I have to give my documents for his application?
Please could anyone give me an advice?
