GDL FAILED

I failed 2 modules from my last GDL(partly due to a failure to obtain exemptions of Contract and Tort Law). After I got my qualification of my own country, I submitted my CAB application again and got admission(hiding previous failure). My last stay in UK ended 2012 August. My former course is a NQF6 course and the new GDL is a NQF5 course. Under current situation, would I still be able get my CAS?
