Post by Tier1settlement » Wed May 13, 2015 3:58 pm

Hi All,

One of my friend who is studying at HTS private college at postgraduate level (Level 7) and course last more than 1 year wanted to bring his wife from India.

Is this possible for him to apply his wife on a dependent visa?

Also what documents are required provide?

Hi
no. You cannot. To sponsor dependent, you should be in Level 7 course in University but not in private college.

I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Thanks for the suggestion.

Can we apply for student visitor for 11 months when her husband is on tier4?

Does the Ukvi see this as an excuse to reject the student visitor visa?

Not student visitor, but short-term student yes.

No, if she is a genuine short-term student.

Hangon

Last night I've checked the definition of "Higher education institution" thr guide tells us to check the register of hecfe and i found my friends college in that list. Below is the link:

http://www.hefce.ac.uk/reg/register/sea ... r/10004060

Is this not something which makes my friend eligible to apply for tier4 dependent visa for his wife?

Guys really need a good advice here.

Thank you all in advance .

Hi
Again repeating; only level 7 university student can sponsor his dependant. LSBF or other private college students cannot. In general, Higher education institute means only University but not private colleges.
Thank you

No. You have overlooked that it needs to be "a publicly funded Higher Education Institution"

With respect, I don't think you should be offering your friend immigration advice.
