hi all,

can some one who is subject to a deportation order and has been been deported from the UK for being given 4+ years conviction from an offence over 10 years ago who is planning to travel to and settle in Ireland with British spouse (married over 10 years in non EU country) be refused EU accompany visa under directive 2004/38/ec?

It should be fine unless maybe the conviction was for violent actions.

They can't decline because of the deportation order, but they are allowed to refuse the visa if they can demonstrate you are a safety threat.

Serious yes - but not necessarily something Ireland could describe as an immediate threat to its national security or public order. The directive gives very little room for member states to refuse admission.
