Two Simple Questions???? Please don't avoid me..

I got two simple questions based on First Tier Tribunal Negative result
1. Can that person apply for ILR if h/she reaches to 10 years lawful residency while h/she was waiting for the decision (to go for Upper Tier Tribunal)?
2. Unluckily If the person doesn’t get permission to go Upper Tier Tribunal from both First Tier Tribunal and Upper Tier Tribunal and still h/she is short of around two months to full fill exact 10 years lawful residency what are the other option h/she will have?
I am sure some of our friends or their friends have gone through this critical situation. Please share your experience or if anyone knows about the immigration laws please help me. I will be much ever grateful. Thank you.
