HI,
I am going to apply for my ILR in OCT if for any reasons it gets rejected/refused and my visa expires in oct'15.
My company wants to sponsor me for Tier 2 . How soon can i apply for it and should I go back to INDIA for applying my tier 2 visa or can i apply it in UK .

As you are on Tier 1, there should be no reason to refuse your ILR unless you have excess absences or a tax issue with different incomes declared to UKVI and HMRC at some point in the past with an extension. There have been a few refusals recently for this reason as deception.

I hope that you have a sponsor in mind who is on the approved sponsor list and are not thinking of the umbrella company or contracting route for Tier 2 as this in not permitted on Tier 2 General.

I am on tier 1 general visa and I have no issues with HMRC my company wants to sponsor me , how soon can i apply it ,
Can i apply it in UK or should i go back to INDIA and then apply from there as my visa expired.

If you have not absence, income or tax issues and you meet the requirements and points, then ILR should not be an issue.

Is your company an approved sponsor?

There is a bit of a process involved. You might be better asking about switching to Tier 2 in the Tier 2 forum. I believe you can switch within the UK before your current visa expires and after the company (if an approved sponsor) does their bits of the formalities.

I really like your true comments! But almost everyone gets worried when it comes to iLR. E.g I am a self-employed and can score maximum points, ie I have no issue with HMRC, Tax paid on time, no absence issue and the only issue which worries me alot is the driving offense 10 months ago, which I challenged in a court! I don't know whether I should have challenged it or not! But I had an option and exercised my right to seek a justice in a court!

What was the outcome of the CCJ ?

You did what you think is right, but untill you get ILR even after after that dont challenge ro go to court.

just accept it and pay the fine and FPN
