ILR eligibility

Hi there;

I am planning to apply for ILR in June alongside my wife using the premium visa service.

Following are my details
Visa type: Tier 2 General
In UK since: 17-06-2010 (3yrs original visa + 2yrs extension)

My wife:
Visa type: Tier 2 dependent
Visa granted on: 04-June-2012
In UK (with me) since: 17-09-2012

I have the following question:

1. Do I need to fill in a separate form for my wife when applying for ILR or the same form is used?

2. Does my wife fulfill the following requirement "they’ve been living in the UK with you for at least 2 years if they applied before 9 July 2012 or 5 years if they applied on or after 9 July 2012".

3. How do I prove my English language requirement. I fulfilled the requirement when I arrived in 2010 via IELTS test certificate. Will it still be valid? I can't see the following option in the SET(O) form "Evidence provided in the previous entry clearance application".

I would be very thankful for your replies.

The question is not when she got the visa or even when she came to stay, but when she applied for the Tier 2 dependant visa. As she got the visa on 4th June 2012, she must have applied before then. Assuming that she has stayed with you for two years (and you may need to prove it, with bills in joint names, etc), the answer to that question would be Yes.

1. One form, you as main applicant and wife as dependent.

2. You will need two years worth of cohabitation documents from roughly 6 different sources.

Were you able to sort the following out?

I am also in similar situation and couldn't get any response on this forum.
