My Friend was expelled from his college due to low percentage of Attendents (42%)...only 7 months remain to go for his 10 Catagory Indefinite leave to remain...he has wife, 2 kids(4 1/2 & 1 1/2 years old) as dependents...if the college inform to UKVI what will happen...any chance to find a new sponsor or any other options like work permit?

please complite advice

Was he working more than the allotted 20 hrs/wk?

Tell him when he gets 60 days letter from HO. Apply on the 58th day use flr fp form.

If he is short of 7 months from now. he will get 60 days letter in 2 to 3 months time and then 60 days top of that so when he apply flr fp he will short just 2 to 3 months. if he get decision than go for appeal or if he complete 10 years when fl fp in process than Vary the flr fp to Set lr.

He is not working at all...
his 10 years completing on 7th of July 2015.
he got the letter from his college about the expulsion on today 12/12/14 with Appeal rights to the college within 10 Working days,
they mentioned after sending appeal then within 5 working days they will send the final decision, if he failed on the appeal then they will send the letter to him and UKVI.
when will be the 60 days start?....one we received any letter from home office or the final decision of the college?...
does he need to inform to home office once he received the letter from college or just wait until the letter from the HO?
IS IT GOING TO AFFECT his 10yeard indefinite application in the future?
please let me know.

HO will send him a letter and give him 60 days notice with a expiry date.

Don't confuse yourself and other by this 2 different things. He needs to satisfy the college that he is a genuine student. If college things he is not than they will inform UKVI.

does he need to inform to home office once he received the letter from college or just wait until the letter from the HO?
Why he need to tell HO about what's going on between him and college? Keep quiet and wait for college decision and HO 60 days letter.

I would recommend him appeal to the college and meet with them.

Perhaps he could explain his circumstances to why his attendance is quite low - such as health problems if any, family issues - eg. child care, child's health issues, dependant care leave etc. If he has any of these and can provide supporting documents it'll work in his favour. They'll understand why he is lacking the required attendance and perhaps help him.

If he's joined this course just to buy time to extend his visa and stay for the 10 yrs to get ILR then the college might notice that he is not serious about his studies. He has to tackle this head on and probably deal with this at college level to avoid visa issues.

then he has nothing to worry...

this would be my suggestion...

if however the college goes ahead with reporting to ukvi u could follow the advice given by others too..

btw, he could speak to an advisor such as those available at student union who can represent and go with him to this appeal meeting.

he better go prepared and armoured for all sorts of questions.

get all advice and help before u go for this meeting or write the reply letter. If nothing works, atleast ask people here to run through your draft/points..

Hi...he has sent a grounds of appeal to his college on 23/12/14 but the college even failed to looked in to his appeal documents ,they just sent reply as explusion from the college on 24/12/14, its has gone nearly 2 months but he has'nt receive
any letters from Home Office(60 days letter), as you know for his Indefinite Leave to remain only 3 month and 16 days short, 4 dependents (wife, 3 kids- 4.8 years,1.9years & 0.3 years).
does he need to wait HO letter / find another college / go for FLR-O for the safe side?
please advice him cheapest and safest way as soon as possible please...please....

Waiting for the 60 day letter is the cheapest way forward. If it takes another couple of months he is nearly there with his ILR.

Is he living in the same address where he received his student visa?

If yes than wait for 60 days letter. i dont think HO will send him a letter because his visa is already near to expire.

Tell him to apply for SAR ( subject access report) to HO. SAR is like his immigration history. Download form from google. fees is 10 pound.

@ sivakala, as Zee ali advised, its very important that your friend find out what address HO have on record for him as they could have already sent out the 60days letter to a wrong address.

Best option is for your friend to call HO directly to find out his current immigration status. Calling HO will not affect him in anyway even if they send him the 60days letter after his call because under the visa requirement he was suppose to make sure that he is legal in UK at all time and since he has been expelled from school, he is obliged to sort out his immigration status as soon as feasible.

Meanwhile, since he got just 5months remaining to clock 10yrs long residency, the 60days HO letter usually comes with appeal right and it will take him another 3-6months or even more for the appeal process to be completed. Your friend can then withdraw appeal and submit his ILR application.

yes the address is the same that he got his visa(until April 2016 )
is there any chances HO keep the report of the college secret without informing me that 60 days letter?....or any chance to sent
them to his previous address?

and if the current address is updated, why would they send letters to previous address?

call them and check the current address, or call them and give the new address. they are very nice and listen to what you say.

Hi aaliya.... I got it....thanks..... If he doesn't receive that 60 days letter forever until his ILR application, then that time home office will ask what was his progress between the time of suspension from college and ILR application?...
Then what will be the best answer for that issue please....

@ sivakala, you seem to be the person in question, and best option is for you to find out your situation from HO rather than wait for what may or may not happen. Calling HO customer service no will put your mind at rest rather than stressing yourself with uncertainty.

yea if college inform home office, there will be high chances that they will arrest your friend whatsoever the case will be.

work permit is easy but expensive and finding another college is a good option but again money matters. if you have enough funds, then you can get any of them.
