Long Residence with FLR(M)

Post by PRiYO » Thu Jul 30, 2015 11:07 am

Dear Learned Friends,

I need some guidance. I received my ILR(LR) 01 JUL 2015.

My wife is on a T2(GEN) visa which is valid till 15 SEP 2017.

She came to the UK on 01 AUG 2007 and extended her stay as below.

01/08/2007 - 31/03/2012 Student
01/04/2012 - 03/09/2012 (Section C while awaiting T1 PSW)
03/09/2012 - 02/09/2014 T1 PSW
06/08/2014 -14/09/2017 T2 GEN

My wife will complete 10 year on 31/07/2017 and intend to apply for ILR (LR) on July 2017.

However, as I now have ILR and would like her to switch over as my spouse.

Question 1:
will she be able to apply for ILR(LR) if she switches to my spouse by applying FLR(M).

Question 2:
I read a lot of stories about resetting clock to zero for FLR(M) applicants for settlement. Does it this effect FLR(LR) 10 years application or they are separate cases?

Your Sincerely
Priyo

1. Yes.
2. Only when intending to apply for settlement as spouse of a settled person / British citizen. No. Separate routes.
