Tier 1 (G) ILR queries

Hi ,

Thank you very much for your information , it’s very helpful .
I am also planning to apply for ILR in this September but I have few doubts/questions for my case

First question :
I have got my VISA (Initial Teir1 general )approved on 6th October 2010
My first entry to England was 28Th December 2010 (approximately after 86 days of my Visa approval , this is within 90 days )
Now my doubt is can I apply for my ILR on 15 September 2015 or I have to wait till December.

Second question : do I have to provide details about all my visits outside UK for this last 5 years ?? , although I had very few that too far very short durations .

Third Question : During my initial application , for English language eligibility I had used PBS calculator provided by UKBA site to show my University was listed on their calculator , but now there is no category for Tier-1 general hence there is no calculator .. what should I do for English language eligibility ??

Do you guys have any templates , sample cover letters for all section of these documentation .

First: You were in total 83 days out between your entry clearance grant and first entry. So you are covered. That period will be counted towards your continuous residency. You can verify it yourself by looking at continuous residency calculation document ILRcont_periods_v12.0_EXT.pdf

I do not see any problem for going ahead on 15th September 2015 as you are well within 28 days period.

Second: Yes, of course you must.

Third: You can refer to Koll_v17_0.PDF easily available on the UKBA site. Below are the steps to get you PBS points printout


To check a degree on the calculator you should use the following process:
1. tier dropdown: select ‘Tier 2 (Skilled workers)’
2. category drop-down: select ‘Tier 2 (General)’
3. ‘where are you applying from?’ question: select ‘Outside the United Kingdom’ (this is the quickest way to get to the required stage in the system)
4. in the following ‘Sponsorship’ and ‘Salary’ stages select either ‘Yes’ or ‘No’ ( it does not matter which)
5. in the ‘English skills’ stage, select ‘I have a UK Bachelor degree-equivalent qualification (or above) that was taught in English’
6. enter details of the qualification in the following drop-down lists, up to and including ‘Year of award’
7. in the table displayed on the next screen, check the ‘Points for English language’ column:
o if 10 points are displayed, the qualification has been deemed by UK NARIC to be academically equivalent to a UK Bachelor degree or higher and to have been taught in English
o if zero points are displayed, the qualification may either have been deemed to be below UK Bachelor degree level, or not taught in English, or both

Thanks for your response .. information you provided was very helpful .
I have few more queries and your help will be appreciated .

Regarding Earning :
During my first Teir-1 general Extension , I have showed 62K as earning for period October 2011 till September 2012 (spanning in 2 financial year ) , as it was more than 55K ( in last 12 months )I have managed to get 35 points for earning ( it’s all valid transaction and tax paid for that salary and dividend -but I had took dividends in such a way so I can meet this figure in last 12 month income criteria)
but as this period span in 2 financial years (2011 – 2012 ) and (2012-2013 ), individual self-assessment for these years 2 financial years was 41K each … is this will create any issues .. does it require to have one financial year to meet that 55k criteria or last 12 months earning before application is only criteria .

for ILR also its also my past 12 months will be span in 2 financial years and my last 12 months Income calculation will be around 56K but my individual financial years income will be around 41K each (due to dividends taken carefully ) .. hope this OK ?

Continuous period in UK :

Initial entry to UK after 84 days of visa stamped (within 90 days I guess this will not be counted as absence )
Initial Tier1 visa approved date : 06-Oct-2010
First entry to UK (London): 28-Dec-2010

73 Days in 2011 ( Till October 2011, I was unemployed giving interview and travel outside all these trips were personal what reason should I provide , although these are much less than 180 days limit per year , do these too many short trips will create any problem ) :

Left UK : 16-Jan-2011
Back in UK :10-Feb-2011

Left UK : 15-Feb-2011
Back in UK : 12-March-2011

Left UK : 22-June-2011
Back in UK : 03-July-2011

Left UK : 08-August-2011
Back in UK : 20-Aug-2011

29 days in 2012 ( personal leave):
Left UK :18 –June-2012
Back in UK : 17-Jul-2012

37 days in 2013 ( personal leave ):
Left UK :14 April-2013
Back in UK : 21-May-2013

22 days in 2014 ( personal leave ):
