Appreciate you responses ,thanks in advance.

I entered UK on 06-JUN-2009 on work permit /tier 2
Changed to Tier -1 applied postal date on 16th JUlY 2010
My curent Tier 1 valid till September 2014 after extension.


Please let me know when is the earliest i can apply for ILR .
I am planning to book personal Appointment on May 12th 2014 as it is in the time period as per rules
"Please do not apply more than 28 days before completing the
qualifying period. If you apply earlier than that, your application
may be refused."



Could you please confirm ,if this date is OK 12th May 2014 (5 year duration starting from 6th June 2009)

Welcome to the forum!

You meet the 5 year continuous residency* requirements on June 6,2014.

Therefore, June 6, 2014 - 28 days = eligible to apply for ILR on or after Friday, May 9, 2014

*Continuous residence: Continuous residence is time you’ve spent in the UK without gaps.You can leave the UK during the continuous residence for up to: 180 days at a time, 539 days in total. You can’t count time spent in: a prison, young offender’s institution or secure hospital, the Republic of Ireland, Isle of Man or Channel Islands

Hi Mind_The_Gap,

I am planning to FILE my ILR in Jan'16.

Can you please share the link where this rule of applying ILR 28 days before to 5 year completion is mentioned. As if its mentioned and proved then it will really solve a very big problem of mine.

It is mentioned on all the ILR form guidance notes. For example, see page 4, last paragraph of Set(O) Guidance Notes (Click)
