Naturalisation - qualifying period and when can I apply

Post by mdakram » Wed Sep 02, 2015 4:09 pm

Forum Members,
I have a question for the immigration experts here.
I received my indefinite leave to remain in Mar 2010. In July 2010, I left the UK as I had a job opportunity in Middle East. I came back to UK in Sep 2011. I have been informed that I lost my qualifying period.

Depart from UK Arrive into UK Days outside
22-Jul-10 30-Sep-11 428
05-Oct-12 13-Nov-12 38
26-Dec-13 31-Jan-14 35
20-Sep-14 19-Oct-14 29

Please, Can someone provide the expert advise?

Regards,
Akram

What do you mean "lost your qualifying period"? What does the letter / communication state exactly?

:?: :?:

Either way, OP needs to explain what his post means and what his query really is about!

Apologies to the forum. My bad. I should have clarified what my question is.

In 2012, I prepared all the necessary paper work to apply for naturalisation and went to the nationality checking service. They said that I have lost my qualifying period because i was outside the country for over a year.
When earliest would I be eligible to apply is my question to the forum here?

I have been told 2016 September is the earliest, but I wanted to get some expert advise.
In the Form AN it says under "Check if you can apply"

* lived in the UK for at least the 5 years before the date of your application
* spent no more than 450 days outside the UK during those 5 years
* spent no more than 90 days outside the UK in the last 12 months
* and more....

I have been told 2016 September
This would be correct. One of the most important requirements too is that you were physically present in the UK on exactly the same date 5 years ago to the date that HO receives your application. If you were not, you will be refused and lose your fee.

The 5 years residence is counted backwards from the date of application.
