Hi guys
I'm new to this forum.
Seems 90% of applicants receive their biometric letter within a month
or less after posting their application, which is good news really.

However, it's been almost 10 weeks since I sent my application, but
received nothing, even no acknowledgement letter or email!!

And is it always that when the HO sends you the biometric enrollment letter
that it technically means that your ILR application has almost been approved?

Can any body who has been through this tell me, plz.

Many thanks

Hi Selfie,

First of all, i am not a legal person and what i am saying is purely based on what i have read which maybe correct. In the guideline to settlement caseworkers, it indicates that the first person that enters your application into the database i.e. the data entry people should send you the letter and place your application in the workload for a caseworker to pick up. This should normally be sent within 10 days after your application.

Therefore, the biometric letter to me would only mean the start of the process/wait and not just before a decision is made. I hope this makes sense and that you hear something soon.

Thanks
m

Hi m
Thanks for your input.
I think you are right.
However, it seems ILR (protection route) applications have no fixed pattern !
It varies from one applicant to another depending on a number of factors.

But, generally speaking, it seems that the biometric letter and enrollment is just like
the beginning of the end!

Once you've done with it, all what you need to do is to wait for the OFTEN successful
application and positive decision from the HO.

Though it's true that the wait could take ages before the BRC arrives before eventually
you receive the ILR itself !

Hi Selfie
Don't worry you are not the only one who hasn't received the biometric letter yet. I have been waiting for 10 weeks as well. I missed a lot of full time job opportunities as I have nothing to show any employer. I cannot afford to pay the council tax but they are asking for Home Office letters/documents. Lets stay positive and hope the biometric letter and ILR will arrive shortly.

Just got the second email from the HO:

We are emailing you to confirm that your recent Home Office application is still under consideration and we expect to make a decision within 6 months of the date of your application, which is our service standard. If we are unable to process your application within 6 months we will tell you as soon as possible.

Hi aistar

I know yeah. It really can be frustrating, especially when all your life comes to a halt,
cuz of this process, and you may miss out some great opportunities !!

The problem is that the guys at the HO don't bother actually to take it more seriously,
and realize that there is sometimes a lot at stake for applicants to lose, as if those applicants have no real life out there and they are very happy to wait, and wait, and wait !!

But, yeah keeping positive is the only thing you can do while waiting, though no matter how
strong or positive one can be really, they can't help but to feel depressingly anxious and sometimes at their edge !!!

It's hard to believe but my friend received his ILR BRP card in 32 days! yes 32DAYS. His 5-year refugee status expired on 16 July, he sent SET(p) form on 16 June and received his BRP card on 18 July!

On the brighter side: you won't have to wait for the one year before you naturalise. Under their discretion because of their delay in determining your application, you can apply straight away after you get your ILR

Hi Mahm
True there is a bright side for the ' agonizing ' wait.

However, he can count for the one year after the ILR for the naturalization
ONLY from the date on which the decision of the ILR itself was made by the HO.

So, if the HO shelved the application for processing and they made a decision say
a week or two before they inform you, the time before the decision doesn't count
actually when it comes to applying for naturalization.

You are only assuming that they indeed made the decision shortly after receiving the
application, but didn't inform the applicants and just shelved the application!!

So, it's a double side blade really !!

Personally, I'd rather receive the decision and then wait the one year knowing it's almost over.

In circumstances where HO delayed an application for more than 6 months, they'd apply a discretion and let you apply for naturalisation just after the decision was made. I've seen and heard of so many cases of the kind and their applications were accepted.

However this is on merit, it's not a definite that they'll accept

Mahm

It's true that it sometimes works well.

However, It's still a risk I wouldn't probably like to take, because it's all about the HO rather vague "discretion " !!

I mean I I might send my application in with the relatively high fee of about £900, and then wait for unknown period, perhaps weeks, and then get a rejection on the basis that '" dear X. It's not been a year yet for the naturalization . Please resend your application when you complete the one year required after obtaining the ILR'" !!

And this could mean losing the high fee and above all false hope and long wait again !!

So, I'd advise to play it safe and stress free. LOL

What do you reckon?

You're absolutely right selfie, in that case I'd write to them and make them put it in writing then attach it with my naturalisation application.
With the way things are moving, I'm taking any risk if it makes my application considered not later. all these immigration reforms, there gonna reach a time when naturalising for refugees And other categories will be impossible. The Con government is under massive pressure to cut down immigration and naturalisation hence why they reformed the good character requirements which made it very difficult for refugees to get BC

I urge you not to despair. These are hard times and government cuts being rolled out across the public sector are impacting on services. Fortunately for us we are still waiting but I'd like to think there are some not so lucky, who are now without jobs in these government departments. The remaining ones working on our cases may be burdened with massive workloads and perhaps not copying with pressure. The general election in a few months isn't helping either, with the government desperate to keep the lid on immigration boiling pot. It is a struggle but we will rip the fruit at some point no matter how long.

Very encouraging
