You have to mention family member of eu citizen.and yes they have to pay the fees as they r permitted family members and not qualifying family members.

Hi,

please keep us updating about the progress of the application.

What do you think, what are the chances of the approval in the application for extended family members. ?

What docs are you going to submit with the application ?

Thanks

hi, your brother has to be dependent on you financially or medically etc. i don,t know much about it, but you have to send money direct to your brother bank account, you will have to prove that you are the household member, like home documents on your name, any bill on your name and your brother name in home country. i have not applied yet, just getting information about it like you.

You have demonstrate that he is a Permitted family member..

Simple money transfer is insufficient .
need to demonstrate that without this support he will be unable to meet his essential needs.

Zambrano- British adult care dependent on non eu granddaught

Post by sblex » Fri Dec 25, 2015 11:05 am

Hi -
We are in difficult trouble - can you pl shed any light?
We 7 members family are British nationals or with ILR status are same house hold in the UK. My niece now 26, non EU national since after her birth living raising by us as same house holder. Used to be in non eu country long before as same house holder. In 2007 - she arrived in the uk with student visa extended to oct 2012, in time private life 276ade application FtT unsuccessful without ROA. FtT UT JR CoA likewise permission refused. 6 month timescale deadline on 21/11/2015 to take
case to ECtHR. UP to JR she was allowed to work as her previous leave continues. It was her misunderstanding that her previous leave plus work permission continuous as long as judicial procedure continues - so she was working paying tax on the record which is unlawful. She was encounter illegal working and detained on 31.10.2015, still in detention. She applied EEA Zambrano application as carer of Adult grandma (likely to be refused). Policy guideline says (1) removal activity should be suspended while EEA application pending (2) if refused there will be appeal right. But HO saying that if refused - out of country appeal right will be given. Can you pl help me -
A) what do we do to get her out or to make her stay in uk
B) does she qualify for release from detention based on EEA application pending
C) what option do I have more to do

Well that is not factually correct, I have been on the forum since 2009, and there are some people that were issued on that basis.

1 of my relative was issued on the basis of being a permitted family member few months ago.

So they do issue if the qualifying criteria are met, and you should not seek to lose hope or heart.

I know there are few cases, here, where the officer at the department totally misdirected themselves in law, and used factors that was disavowed in Metock to refuse, and in other cases refuse to recognise evidence provided to demonstrate dependency, but it is wrong to say they don't issue.

I have made a freedom of information request with the department on Residence Card issued to Permitted family in the last 3 years.

If or when they get to me, I shall publish their response on the forum.
