Home Office Response (via what do they know)

Post by fatimahh » Thu Dec 10, 2015 10:46 am

Dear All, i know i keep on dragging the same issue but i am really worried :? :? :? :? :?
please note below the request i made and the response from homeoffice.

Dear Home Office,

Could you please advise on a list of all funds which are accessible
to a person with ROR following divorce to an EEA since nothing in
the
sticker indicate no recourse to public fund.

When a non EEA with ROR is working and claim housing benenefit ,
child tax credit, and child benefit does that affect their
residence card or future application?

Yours faithfully,

Dear xxxx,

Thank you for your email.

EEA Nationals and their family must not become a burden on public funds.

• May claim “top-up” benefits for low-paid or part-time workers (15 hours per week), also persons who are involuntarily unemployed

• The Home Office cannot instruct the Department of Works and Pensions (DWP) as to whether an individual can be paid public funds or not, we can only advise DWP of the person’s Right of Residence and the exercising of Treaty Rights in the UK.

If you claim Public Funds ( Housing Benefit being one ) then this may affect your application in the future for permanent residency .
Yours sincerely ,

Hi fattimeh,
It indeed may affect future application but try and go through this attachment for further clarification. https://www.gov.uk/government/uploads/s ... 2_0EXT.pdf

Hi Fatimah,

I believed we have discussed about this issue many time.
It advisable to maintain worker status throughout your ROR till one aquire PR just to be on a safer side.
It is really good to help and everyone deserve to be respected in life. Good luck.
