Change of Name (marriage) ILE in passport

Post by CR001 » Sat Dec 12, 2015 1:20 pm

Hi,

Asking this question on behalf of a friend.

Nationality : South African
Came to UK age 16 in 1999 - ILE
ILE granted in old passport as mother is British by descent born in Rhodesia to British born parents
Renewed foreign passport without any problems and never transferred ILE.
Recently got married and applying for new foreign passport in married name
Works full time

Question is, does she have to change her ILE to a BRP with change of name and inform HO? If yes, which form as the the HO website is very generic and I can't seem to identify which link to send her and know there have been some changes in regards to ILE in passports and BRPs.

She is looking for the most cost effective solution.

Thanks

Char

I've not done this but it looks like this one - form NTL:
https://www.gov.uk/transfer-visa
You must immediately report any changes to your:
name (eg because you’ve got married)
but also note ...

:!:
You don’t have to transfer your visa - you can carry both your old and new passports when travelling to or from the UK instead.

Am aware of the two passports etc., however, will the ILE in maiden name on old passport have any effect on BC application with new foreign passport in married name? :?

How about the right to work?

My understanding is that the old passport will need to be cancelled (not just to have become expired) to avoid any issues around names; (maiden verus married).

My further understanding is that ILE is a form of ILR - so an existing right to work (in any name) should be retained.

She may continue to work, if she has current employment. But new employers would expect her to apply for NTL if she has a new passport (see also 29).

Thanks Vinny. So no need to change to BRP after marriage unless seeking alternative employment.
