Tier 2 ICT migrant with ILR - Dependent Spouse

Post by Qadeer786 » Tue Dec 22, 2015 2:54 am

Hi,
I am currently on ILR (issued in Aug 2013) and my previous visa was Tier-2 ICT (Long Term). I got married in Oct 2015 and want my wife to join me in UK.

Based on what i read, i am confused on what visa she should be applying for. Reading throu UKBA, i believe it should be "Family of person settled in UK" visa. However when i go to visa4uk, i do not see any such category. I only see "Settlement - Wife" as one of the category-subctegory. But is she eligible for settlement right-away?

On further reading i thought it would probably be "Family members of Points Based System migrants".. But this seems to put a condition. How would this be possible.. If she cant apply under settlement, cant apply as
family of PBS migrant, any idea what the right form is ? Any links or pointers pleaseeee? Appreciate your help.! :)

the applicant and PBS migrant must have been living in a
relationship similar to marriage or civil partnership for a
period of at least 2 years

If you hold ILR, then there are no provisions for your spouse to apply for entry clearance as a PBS dependant.

She may apply as the spouse of a settled person (5-year route to settlement).

Hi Vinny,
Thanks for your quick reply.. Any idea what form would that be on visa4uk ? I believe the only relevant visa i can see is "Settlement - Wife".. Do you know if its the right one ?

Also for settlement - wife, i believe i need to fill V4F4A financial requirement which states that i should be in UK in last 6months (Category A).. I came to UK 4months back (was in India for about 2years before that, so category B cannot be applied either).. So do i need to wait 2months more before i can be a sponsor for her?

>Settlement
>>Settlement
>>>Wife
Is the correct selection for the visa. The form is VAF4A. You need 6 months payslips and bank statements.
Char (CR001 not Casa)
