Child dependent visa - father ILR, mother PBS T2 dependent

Hi,

I got my ILR in Feb2015. My wife was at that time in UK and renewed her visa as PBS T2 dependent which is valid till 2017.
my wife went to India to for delivery. now i need to apply for my new born child's visa.

Can you please help me in the visa category? do i have to apply settlement - Child or other dependent of settled person visa or i have to apply PBS T2 dependent?

Please help. I'm getting mixed responses from people?

If you were granted ILR under PBS, then child may apply for a PBS Tier 2 dependant entry clearance, in line with wife's.

Else, both wife and child should apply for settlement entry clearances under Appendix FM.

Thanks vinny for the response.

I got ILR via 5 year PBS T2 ICT route and my wife's leave to remain was issued with in UK on PBS dependent category. her visa is valid till feb-2018

Now she is in India and child is also born in India. I need to apply for my daughter's visa.

One solicitor totally confused my now , he is telling both Mother and Child has to apply for Visa again in India via Settlement route?

I hope and pray that he is wrong. Please help vinny.

Thank you vinny.

Now problem with the IHS surcharge fee. In that site, if i select PBS tier 2 ICT longterm staff -child , surcharge comes as £0.
But if i select Settlement route, surcharge comes as £1800 ?

Vinny could you please help me what should i do here?

Tier 2 ICT and Tier 2 ICT dependents are exempt from the IHS charge and DO NOT have to pay it but you DO need the IHS reference number. £0 is correct.

DO NOT apply for a settlement visa, this will reset their qualifying clock for ILR to zero and they will have to start again from scratch with a new 5 years residence.

Thanks CR001. But in the site, it says i need to provide CoS no. As i have now ILR, my company didnt provide the CoS now.

Can you help how to proceed?

In case of confusion, can I apply settlement visa only for my child?
