7 month still no accompany EU spouse visa need help

As I have perviously mention that I have applied for eu accompany visa for Ireland in June 2015 and still I am waiting for the decision.... Even today I got an email saying that they are currently dealing with application recived in May 2015, means I have to wait probably another three or four month as my application was recived in end of July 2015 Although I applied in June 2015,

Now I am thinking to send an email and threaten them, How could I threat them ???

And also in the mean time can i get my passport and other original documents a back from the embassy???

And once I got my passport back would it be possible that I can apply for accompany Eu spouse visa for any other eu country ????

Plz any advice would be appreciated, I am very upset I have been waiting since 32 weeks still that have not examined my application.

Hi umair,

you are right i know two of my friends applying in june and they are also waiting. and i seen here that they are keep telling that story from last Nov that they are considering May 2015 cases,


it happend to me when i apply back in june 2014. and they were keep saying that it is under prosses blah.... blah.....


then what i did i contact to SOLVIT( free service ). they took my case it was sort out 2-3 weeks.

i also complain in Europ union commition as well.

so you might do the same thing its might help. i know 2 ppl waitng since June if you want we will send all that complain at same time if we complain in group thats might more help full... any body els want to join in complain...??

I would like to join in complain. Do let me know please. .I have applied join spouse in first week of October and they category is short stay But they r not only keep on telling me about my file in wrong category but also delaying my case. My husband is British national and exercising his eu treaty rights in Ireland.
We both also decided to contact UK solvent for the breach of Eu law. Ireland immigration ppl e literally playing with the law or might b only in case of Pakistan they r doing so. But whatever it is...it is pathetic ....

Hi guys. New to the forum :D . We applied for Section C accompany visa in Sept 15 and up until the end of Jan this year there was no decision. Tried getting a solicitor to file a Judicial review and even that didn't work. So requested my documents back end of Jan got them last week. I'm a Zimbabwean national and my wife and son are British (well he holds both nationalities really). Applied for Schengen on Monday this week at our local French embassy and we got it today. :D :D :D :D.

Honestly, with Cameron's referendum agenda now being touted as sometime in June we decided to grab the bull by it's horns and just take drastic action. Getting that article 10 is important to keep me with my family and with all the uncertainty of how the referendum will go, what the reality of a Brexit will look like, etc it's just better to be in a secure position pronto.

My advice (if you need it) is to think long and hard about this. Sure Ireland is an attractive option with the all it's advantages but given how long all this was probably going to take- Some say they have been waiting over a year for their Irish article 10 RC after waiting another 6 months for the accompany Visa- the cons trump the pros for us and we are OUT. We'll be going to both France and Spain to see which country will suit our family life better but the language barrier is something we will have to overcome. Goodluck

According to visa guideline "applications from qualifying family members must be accelerated" i.e. processed within four weeks from the time that the application is first received in an Irish Visa Office or Mission, so they are violating the Directive and should threaten the Department.

Well we wrote letters, emails and even my solicitor sent them a
Letter and then legal proceedings notification but they just respond
with the same generic stuff "high volumes of applications" "curreny
examining applications in May 15" etc etc. Maybe someone needs to
do a Mccarthy type case and I have little doubt that they would be fined by the ECJ.

Hi.
I applied in early May 2015 for eea Irish accompany visa up now no answer. I involved solvit after three months useless they emailed we r closing the case unresolved.
I have applied for judicial review judge delayed the decision twice up now waiting for the third time what will judge decide.
There is no other legal action left to take against them.

Hi Umairks123. Yes I withdrew my application- as I said in
my post we have since applied and have been issued with
a Schengen visa. We just think there are quicker routes via
mainland Europe than Ireland.

Hi, I disagree that there is no other legal action as you could take. You could take the matter forward to the European Court of Justice just likethe McCarthys did however such a process could be very expensive and lengthy. Also by then the UK might not even be in the EU/EEA.

@Uma. I noticed you sent me a pm but unfortunately I could not

Basically I applied as a tourist and submitted:

1) Itinerary flights (you need these to show a return flight to
your country)
2) Marriage certificate
3) Passport copy of my wife and son (EU/British citzens)
4) Proof of funds (we had two Bureau de change receipts from
Barclays Zimbabwe)
5) Hotel bookings Itineraries (booked on Expedia.co.uk)
6) Proof of address
7) Passport photos.

Went for the interview, French lady was really nice, asked me
why we were visiting and I said we were going on holiday. I did
not mention anything about my wife exercising her treaty rights
as I believe (from my own reasearch) it can be a can of worms.

Where are you from and what is your situation if I may ask?

Thanks for your reply, that really helpful but I am bit confused As per directive law when Tu exercise treaty rights they don't need to show price of funds???

Even if I have to show how much money do I need to show them ??????

My wife and son is brtish national, I am Pakistani national applied for Ireland short c visa in June 2015 and since no decision has been made,

Now I am thinking to take my passport and original document back from Irish embassy and applied for another eu country

But I would like to wait the outcome for my Dublin visa application I don't want to draw my application,

My question is do I need to show funds??? For accompany eu visa for any other eu country ????

And can any body suggest me about Denmark,Norway or Sweden what are the current processing time ???

I am computer engineer and it will be easy for me to find a job based on my 8 year experience in Middle East, guy plz help me and give me an advice what should I do know???

Solvit has closed my case unresolved and Eu commission dnt know when they will reply me about my complain.

@Uma- well according to the Directive you do not need to show
any funds. Just your passport, Id and proof that your wife will
be exercising treaty rights/entering another EU state is all that's needed.
HOWEVER. The reality is quite different and difficult.

Given that mentioning the exercising of treaty tights resulted in
delays for our Irish application for a Section C accompany visa,
we decided not to take that risk again. Who knows, maybe doing
that would have resulted in the French embassy taking longer (no
evidence to support this, just our suspicion).

However pose as a tourist with strict holiday bookings and it
seems they will jump around quick. Obviously it's just my
opinion. I think I read somewhere on here that if you apply as
a tourist your visa is usually issued in standard time. Some
have been applying for tourist visas for Ireland and getting
them in 6 weeks for example.

What if I don't withdraw my Irish application and also apply for a schengen tourist visa, becuase on schengen visa application they only ask for have u applied for another schengen visa before which Ireland is not part of schengen.

Will that create any problems?

The department can release your application pending consideration of your case.

There are many court cases pending in the court in regards to the delay.

I think the court is seeking to do a lead case and perhaps the department will comply and start acting lawfully.

The judge has twice delayed decision on my JR. The second delay was for the that department of justice was not ready to present the case in the court the judge gave them more time to be fair with department.
What do u think that the judge will decide third time is there any chance of delaying the JR again or the judge will tell them to make a decision on the applications?

You rep must insist that the department has been given sufficient time and the matter must proceed, giving the nature of the rights in question.
