Does the proposed codes of practice will have any effect?

Post by anoops1984 » Mon Feb 15, 2016 2:25 pm

Hi All,

My ILR is due in September 2016 and I am earning above the required limit. Recently I read this MAC review news release on gov.uk site.

https://www.gov.uk/government/uploads/s ... _FINAL.pdf

Some of the topics in that are terrible like increasing minimum salary threshold for the new entrant to £30,000 from £20,800. My job code in Tier 2 is 2136 and the minimum salary for the experienced is £31,100 at the moment. If the new entrant threshold is going to be £30,000 then there is a chance the experienced rates will go over the roof.

I just wonder does anyone have idea how this will affect the people already on Tier 2 and going for ILR?

Kind regards

As far as I understand,

For new entrant it’s going to be minimum £23k (Recent graduates)
Experience hires £30k minimum

And MAC has recommend to keep the salary threshold at 25th Percentile for experienced hire (same increase as every year) read page 218

https://www.gov.uk/government/uploads/s ... _FINAL.pdf

But can’t really guess anything now, will have to wait till April 6 and find out. Good luck

Post by anoops1984 » Wed Apr 06, 2016 8:24 am

Hi All,

Is there a new codes of practice document available to verify the experienced pay rates for applications submitted from 6th April 2016?

Thanks

Hi Dinesh,

Yes, I think so. I am eagerly waiting for it too! Fingers crossed!

They have already published a new policy guidance today: https://www.gov.uk/government/publicati ... r-2-worker

The new document will mostly likely be made available here: https://www.gov.uk/government/publicati ... ation-list

Best wishes,
B

We don't work for HO, so it would be a guess if we stated anything. Keep an eye on the website, it is all you can do.

No update as of yet. I tried exploring other parts of gov.uk too. :( The delay may be because of the nurse's issue I guess.

It is worth noting that in 2014, they updated the list on 6th May - not 6th April. All that we can do now is wait and watch.

Kind regards,
B

Hi,

I am just wondering, what is the significance of the SOC codes list anymore given that most of the ILR applicants will have to meet the 35k threshold ?

Does anyone know how the appropriate rate and the new 35k threshold work ? Does the ILR applicant need to meet both of the requirements or only the 35k ?

Thanks,

The SOC list is for renewing the Tier 2 visa - which is different from applying for ILR. So for 2136, I can renew my visa today if my salary is £31100, but I cant apply for ILR as it is not £35000. You cant stay on Tier 2 for more than 6 years, but I have completed only 2 years so far - so my interest is only in SOC list at the moment.

If your SOC needs a salary higher than ILR requirement - you obviously dont have to worry - as you must have had a bigger salary in 1st place. If you are nearing your 5 years and wish to apply for ILR via Tier 2 route without £35k salary - you have a big reason to worry.

Kind regards,
B

Looks like Tier 2 ILR applicant need to earn minimum 35k and if the experienced rate for soc code is more than 35k then their earnings should match or above experienced rate.

Hi guys,

The new SOC CODES document is not published yet. Do you think a call to the home office would give us some kind of up to date info about our individual soc codes salary rates ?

Thanks,

Hi A J,

A friend called them today. They said that they dont have the new SOC list yet, and that as of today - use the list published on 19th November. :(

Although my extension is in October, I want to have enough time to find another job - should the worst happen.

Kind regards,
B
