Extension points according to Immigration rules

Dear users/Moderators and guru.


Attributes: pass mark = 75 points

Points available

First: investment: 20 points

how can claim the below points
Second: The applicant has registered with: 20 points
 HM Revenue & Customs (HMRC) as self-employed
 Companies House as a director of a new or an existing business -

Third: Register Director of the company: 15 Points
On a date no earlier than 3 months before the date of application, the applicant was registered with:

Fourth: Job creation: 20 Points

my question if some have leave to remain in country initial application who can he/she claim second Category points. i mean it say one can be register within 6 months with hmrc or companies house.

For extension there is requirement that one can be register with HMRC or companies house within first six months after their entry clearance (those who applied outside UK)20 points
But how about those who's have leave to remain (in county).
I have in county leave so still need to show some documents to
Claim these points.
Current appointment report (three months old)
Can be use for how many points

If you switched in the UK, you have to be registered with HMRC as self employed or as a director of a company within 6 months of entering the route (the date you were issued visa)

Self employed: You need to supply HMRC documents/welcome letter proving the you registered as self employed
Company directors: You need to supply a recent Current Appointments Report from companies house

I am not aware of any difference upon extension on whether you originally applied in/out of UK

20 and 15 points respectively.

Yes, If you register within 6 months and remain a director until your extension, a single Current appointments Report will cover let you score 35 points.

hi,

I have a little situation, I am weeks away from my extension. and my company filing history has this.

1) I formed this company, as a sole director in March 2013

2) I resigned from that company in April 2013 as some one told me that I should not be the director of the company for which I was going to apply for (also I was on Tier 2 visa at that time, and I am not supposed to start a company during that time, otherewise, I will be violating the immigration rules). My brother became director of that company on the same day I resigned.

2) I applied for visa in May 2013 and got it.

3) In June 2013, I again became the director and my brother resigned.

4) After this, I have been the sole director and been operating a genuine business ever since.

Given this, my question is, have I done ok here to satisfy the req. of registering as a director within 3 months, or is it considered as taking over someone's business (eventhough, I started it in the first place with the sole purpose for Ent 1 visa)

I think ukvi is looking for two points
First, director need to be registered within 6 months for the entry clearance.
Second, director need be acting in the company (three months old CAR ) need to present at UKVI.

Your can ask any immigration solicitor or accountant about issue but as for as I am concern I did not see any issue with your case.

hi,

thanks for the reply. I understand your points. But my question is, becoming a director of an existing company is not considered as "taking over" of a company ?

it is just that if that's the case, I understand I need to submit different set of docs for employee creation.

any input from Zimba please ?
