ILR Tax issue

ILR Tax issue

Hello Experts,

Apologies for such a long mail.......:)

I am due for ILR in June 2016 via 5 year route. My case details are as follows:-

Student Visa:- Sept 2007 to March 2009(Middlesex University)
PSW Visa:- May-2009 to May-2011
Tier 1 Gen Visa:- June -2011 to June -2013
Tire 1 Gen Ext:- June -2013 to June -2016

I was self employed in year 2009/ 2010 and 2010/2011. In June 2011 I got my Tire 1 general visa at the time of application i showed 35K+ income at Home office but while filing returns I and my accountant and I did a mistake and we filed return for 28K there were 2 reasons for that:-

1) The accounts submitted were not for proper accounting year (April to March) and
2) I closed self employment and started working for a company (Salary £50K)

My Tier 1 extension was in 2013 and I got it same day.

Now for ILR my advocate told me that given your Income in 2010 -11 is just £28,000, you will need to amend tax returns for 2010-2011 which i have done and sent an adjusted income statement to HMRC on 5th on May 2016 and having spoken to HMRC they said it may take up to 2 months for them to update the system for 2010-11.

My question is will this be a big problem in my ILR application and if so what can i do to over come this? I will be sending application by post in 3rd week of June.

Please advice.

Hi Achal,

Nowadays Home office is very strict with the earning points. They are absolutely checking 5 years income and they have direct access to HMRC system.
Chase Hmrc every day as it's taking really long now days ! Even m in same boat, have done amendments but still don't know Homeoffice will accept amendment or not?

The only queastion they will ask is why are you amending now after 4 years ? what do you tell if you say accountant error they wont agree. As it is your responsibility to check the tax records. if you can justify then there is a chance to fight i believe.
