I am on tier 1 General and she is a dependant on me.

I know i have to produced all the same documents as elarier along with the tax documents SA302 for self

But confused about her ....

She may continue to apply as your dependant until she's eligible for ILR.

Is it possible if you could explain that

If I got ILR then my wife would get a dependant visa for how many years if she could not pass the tests

She is dependant from the last more than 5 years and in the UK

Hi
I am going to apply for ILR through Tier 1 and my wife with a boy are here since feb 2012 since my wife has not passed the LIUK and english language so she can't go for ILR but what about the boy status .. can he qualify for ILR if i go for window first and then apply for him.. is that possible.

Can my wife can gett any visa without english test if not and she goes for FLRM with A1 english test how it will effect the boy visa.

Any help will be hightly appreciated

She cannot apply for FLR(M) if she does not do the English test.

Why do you want to do FLR(M)? She can extend her PBS Dependent visa if you are applying for ILR based on 5 years residence.

Child will follow the route of the mother.

Likely she will get a 2 or 3 year visa extension as PBS Dependent.

There is no income requirement for PBS Dependent. You need to show maintenance balance.

You can send their applications by post after you get ILR and before their visas expire if you wish.

How long has she been in the UK?

What are her visa start and end dates?

You have not provided any of this information so how do you expect us to advise or guess your circumstances.

She got her first visa Tier 1 Post Study Partner in Feb 2011 and came to the UK in March 2011. Went back home in September 2011 and Came back to the UK om 5th Feb 2012.

She got her next visa Tier 1 General Dependent in June 2011 which was extended in 2013 but remained in the UK all this time. The present Visa Tier 1 general dependent is expiring in June 2016.

PBS (Dep) Guidance (version 11/2015) - page 5
Periods of grant
30. We will grant leave in line with the expiry date of the PBS migrant’s (or main applicant’s) leave,
except where the PBS migrant has been granted indefinite leave to remain. In these cases, we
will grant you a period of three years leave. An application for further leave may then be made if
required to take you up to the applicable qualifying period for indefinite leave to remain.

Hi

I have post my ILR story on the board

now applying for Wife and son visa. My wife has passed A1 so she can go for FLM but some one said to me that your son can apply for ILR because he is here since feb 2012 although he was born back home

can some body know this from some where

Why are you applying for FLR(M)? Applying for FLR(M) will reset her clock to zero for ILR and she will have to start again with a new 5 year residence requirement.

She can continue to extend her PBS Dep visa until she passes LIUK for ILR. This has already been advised in your other long topic.
