TOEIC case update with new evidence

Post by atmone » Thu May 26, 2016 9:39 am

Hi guys,

My solicitor called me today and said HO have sent us a CD with voice recording.

It is my voice though. So I am not worry about the hearing. But I believe someone will do.

HO now does have some so-called solid evidence.

Please be prepared.

Will you be providing your own voice expert at your hearing?

Nope, I dont think there will be an expert there on the day.
Do you think the respondent will bring one?
The CD with recordings on is the only thing we have received.

Caseworker plays recording.
OP says yes its me.
HO says no its not.

Wondering how this can work out.

Presumbly a top-notch voice analysis expert could settle the case once and for all and potentially shoot the accuser's down in flames.

Finger crossed.

Is that allowed to take a voice expert to the court without noticing anyone?
I think I may need one since HO sent me the CD.

Thx

And toes!

I don't know the answer but suggest you dig into that critical question ahead of time.
After all, forewarned is forearmed.

I'm aware of the concept of McKenzie friends in UK proceedings - and here's a starting point:

Thx for your link, I have had a look and realised the MF can actually do nothing about the case. Even I do find an expert to help me on the hearing day eventually. He can do nothing except moral support.

My hearing is on the coming week.

His Judgement is quite helpful to someone. As he emphasised in [102]-[103],...all appeals will be decided on the basis of the evidence actually adduced.

So I believe you can rely on this case at some point but you also need to be prepared.

The hearing has been adjourned again as the Judge instruct me to get the recording analysed on my cost.
