Top up application

Hello

I have a question for you all. I'll be eligible for ILR very soon but my visa runs out few days before my 10-year mark (28 days early application included). Now, what could I possibly do.

1: extend my current visa and change/top up the application to ILR while its with HO ? if that is possible, is there a link on HO website that indicates this.

2: send out of time ILR application (less than 28 days out of time). this is my least favourable option.

in any case, I would like to go for the same-day service. understandably this is the favourable option for most.

all suggestions are appreciated.

You could go for Option 1, and then Vary your application for ILR.
When you complete 10 years you could ask your postal application to be changed to Priority if you pay the additional fee.

Is it possible then to switch postal application to premium application ? Do I have to write to HO prior to booking/attending the premium service? would they have my passport, ect ready on the day ?

HOW TO TRANSFER A STANDARD ROUTE (POSTAL) APPLICATION TO PREMIUM SERVICE

24 May 2016
On 19 May 2016, the UKVI implemented a new policy which allows the applicant to transfer a postal application to premium service. The current fee for this type of service is £400 per applicant if not attending the application in person or £500 per application if attending in person. Please note that only applicants who used the following forms can apply for this service, SET(M), SET(O), SET(LR), SET(AF), SET(F) and NTL (No Time Limit). In addition, applicants who apply for Indefinite Leave to Remain under the Tier 1 Entrepreneur or Tier 1 Investor can only go for the standard route (postal service) or in the case of Investors, the Super Premium remains an option .
Eligible applicants will need to complete the premium service request form as well as the payment form and send them via email to premiumupgrade@homeoffice.gsi.gov.uk. These forms can be downloaded from https://www.gov.uk/government/publicati ... quest-form. The UKVI will take the payment using the card details provided on the form. Once the payment is successfully taken, the UKVI will send an email confirmation and process the application.

Few days short of 10 years

Hello everyone,

I will be completing the 10-year route very soon but will be less than 2 weeks short (-28 days). what do you think is the best way forward. (1) apply for ILR and delay biometric ect till I complete the 10 years, and in this case, would HO office consider the date of the application sent (which will automatically lead to refusal and lose of fee) ?
(2) extend my current visa and vary the application when I complete the 10 years ?. Note that I may not be able to do option 2 for other reasons.

Hi user001

i had 12 days + 28 short i asked of couple of solicitors for their opinion which option should i choose.
1. Apply Set LR before qualifying period 12 days + 28 days or
2. I should go for FLR O then vary my application to SET LR after 12 days.
I received mix advice one expert says go for SET LR postal application, by the time caseworker will make decision on your application you will have completed qualifying period for SET LR and you will be covered by 3C leave.
2nd advice i received go for FLR O then Vary it after 12 days according to this expert this is safest option.

I have read in this Forum people has chosen option 1 and got success and some people have chosen option 2 and also got success. and i have read in this forum one person has made FLR (FP) and after completing his qualifying period he booked premium service and got ILR ( not same days) please see link

If I was to extend my current visa, can I still apply for ILR premium service bearing in mind that they would still have my passport ? what would I need to do if going premium as this is an option I very much like to take.

it looks like I may not be able to extend my current visa to cover the 10 day gap. do you think I still can apply for ILR ?

Guys,

would section 3C cover the 10 day gap ? would HO count the day the receive ILR application as the date which 10-year residency is counted ?
