Switching from Tier 4 to Tier Gen

Post by Rizahidam77 » Fri Sep 30, 2016 10:44 am

Dear Board

We are a Tier 2 Licensed Sponsor, we wish to hire a man who is 22 years old and just finished his Bachelor Degree in the UK. In our understanding, while switching from Tier 4, we need to issue an unrestricted CoS !

Concerning above situation in mind, we need to clarify on below questions if kindly help.

Does the migrant need to meet the Resident Labour Market Test ?
What salary band "New Entrant or Experiences" should be given ?
Does the migrant leaves and re-enter the UK during the period of approval (if we tick YES) then what would it mean?

Considering his age and previous visa category this would be his first employment.

Thank you very much.

1. No, if he has completed his studies and has his degree in hand.. result awaiting is not acceptable. His student visa must be valid too.
2. new entrant salary is fine , as long as cos duration is not over 3 years.
3. this means if u would like migrant to leave and enter uk on regular basis.. like for business purposes. Going on holiday is not included in this as that is something else. . Only tick this if u want to send him abroad on regular basis for business purposes.

Thanks for your kind information.

There is one more question concerning the same applicant.

The applicant is Azerbaijani National who was required police registration within 7 days of arrival in the UK in his last permission as Tier 4 General Student. But the applicant had forgot to do so and now his visa is expiring on 9/11/16. Although, he has booked appointment with police to get police certificate but ...

Would this affect his Tier 2 Gen visa application if the applicant have not got register with police or if he register now which is very late?

Kindly suggest what should be the best action in this scenario?
