Spouse to Entrepreneur visa

Dear All,

I'm at final stage of opening a start-up with a friend who is UK citizen. Our plan is to raise the initial seeding capital of £100,000 through one of the crowd funding websites and confident to achieve that amount.

My question is in regards to my visa -

1. I've studied MBA in London and than got married to a UK citizen, we have lived together for 4 years and I'm due to apply to my ILR in September 2017. I changed from student visa to spouse visa after marriage.

2. I'm unsure where the marriage is going with him at present, his stress at work has taken huge toll on our relationship and I'm worried if he may want to go different paths in life before even we get to September 2017.

3. If this happens, the business which I'm about to open with a friend help me get Entrepreneur visa and I can continue to live here? We are about to go live in 1-2 months and raise funding by March.

It seems that I can't transfer from Spouse to Entrepreneur visa. Would you agree?

That's my understanding as per:

You must leave the UK and make your application from abroad if you’re in another category.

You cannot switch in the UK to become a PBS main applicant from a dependant visa. You need to apply from outside the UK.

I am not sure about the question that you asked.
However, I think you should be allowed to stay in UK in case the avoidable takes the toll. If I am not wrong surinder singh route is related to this.

Your post has no relevance to what the OP has asked. As a person on a spouse visa (married to a UK citizen), retained rights of residence is not possible if the relationship breaks down. Surinder Singh also has nothing to do with UK spouse visa or relationship break down. OP is on the UK immigration route and NOT the EEA/EU route.

Surinder Singh and EU migration route is not applicable to someone wishing to avail of UK domestic Tier 1 visa route.

An estranged partner would not be a good candidate to contemplate undertaking a 6-9 month or 1 year SS adventure with, somewhere in Europe.
