What visa Category should i apply

What visa Category should i apply

Hi experts,
I'm really not getting clear information from UKBA on what category i should be applying my next visa extension. I'm one of the unlucky one who got visa after the change of 5 Year rule for dependents which was change in July 2012.

I got my Tier 1 dependent Visa on 27/12/2012 valid until 01/03/2014
I had to apply for extension in 2014 and got tier 1 dependent visa valid until 01/03/2017. I will be 5 months away on 01/03/2017 to apply for ILR. so i assume i will have to apply for 1 more extension.
Question here is. My husband is now British citizen now. he changed from Tier 1 general to ILR and then applied British citizenship. in this case, can i apply for Spouse visa? or should i be applying for Tier 1 dependent?

I would prefer to apply spouse visa as it is cheaper than Tier 1 dependent.

Can you experts suggest?

Maybe because UKBA doesn' t exist anymore.

And be careful, as per my understanding, if you jump ship to spouse visa your ILR clock gets reset.
Potentially expensive mistake to make and a false economy.

Always weigh costs versus benefits and risks veraus rewards.

When was the application that was granted on the 27-07-2012 lodged?

Second, did your spouse secure ILR under PBS or Long Residence Provision?

Application was made on 18.07.2012 and visa was granted on 27.07.2012
my husband got citizenship through 5 years Tier 1 general and 1 year ILR visa

i also notice that there is Immigration health surcharge to be paid with application. who are exempt from this?

There is only ONE visa category that is exempt and that is Tier 2 ICT applicants and dependents. ALL other visa applicants have to pay the surcharge.

2 final questions
hope i can still apply as tier i general even if my husband is british citizen(through 5 years of tier 1 +1 yr ILR )
i see that there is online application, how early can i apply and do i need to book appointment seperatly?

i see that there is online application, how early can i apply and do i need to book appointment seperatly? There is also a paper form. You can apply whenever. You will get a 3 year extension as PBS Dep. I don't have experience of online forms as finished my journey 5 years ago. See Book an Appointment (click)
