Tier 4 5 Year cap , time before 2009

Tier 4 5 Year cap , time before 2009

Hi All,
We all know Tier 4 got 5 year cap for Level 6,7 and 8.
Is that 5 years includes the time a student spent in tier 4 before 2009 also?

I came to UK in 2007 October and stayed as student till 2012, after that I am on Tier 2 . Now If i want to study another masters do I still got time that covers in 5 year cap?

Yes. See immigration rule 245ZV(ga) for entry clearance, and immigration rule 245ZX(ha) for leave to remain.

They both confirm that

the grant ... the applicant is seeking must not lead to the applicant having been granted more than 5 years in the UK as a Tier 4 (General) Migrant, or as a Student, to study courses at degree level or above
