Please either continue in your own topic or start a new one. It is unfair to the original poster of this thread to tag your question onto it and it creates confusion when members respond.

This thread belongs to member mallick and isn't a general discussion on spouse visa applications. Tagging your question onto other members' threads not only causes confusion, but it also unfair to the OP. You won't be given an answer here.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

1) It depends on where you made the application.

If you applied for leave to remain in the UK, then you cannot make an application, unless you withdraw your appeal.

Section 3C would end after withdrawal. Overstayer have 14 days to make an application.

Else, if you applied for a visa from outside the UK, then you do not have to withdraw the appeal.
