flr-fp can anyone give me some info ASAP please

Post by vitchd » Tue Jan 31, 2017 9:59 pm

I came to the UK on a marriage visit visa and got married to My pregnant partner who is now my wife.i apply for flr-m and it was refused with of country appeal and was told to get entry clearance from home country.I couldn't leave because my wife Was due to have baby I'm less than a month after refusal and her and her delivery wasn't normal because she were suppose to have a cesarean (c setion).I then apply for flr-fpwhen the baby was born from in June 2016 and have done all the necessaries and it's over 7 months now and still no decision. Can some please advised me because I'm very worried. Thanks in advance

Why did you apply for a marriage visitor visa which required you to leave the UK after the wedding (within 6 months), instead of applying for the correct fiance visa?

It would have been wiser to return to your home country and apply for a Spouse Settlement visa rather than drawing out a long FLR(FP) application which by no means is guaranteed to succeed.

It could take a year or more before you get a decision and while you are waiting you will be unable to work or access the NHS for medical treatment unless you pay 150% of the cost.

I'm assuming that after the FLR(M) refusal you submitted a FLR(FP) Partner 10 year route application :?:

Thanks for the reply.
After the refusal of flr-m I ask for a reconsideration of the decision but it was rejected because of the out if country appeal I get. I couldn't leave because at that time my wife had the baby and was ill so I had to be there to look after her and the child. I then seek another solicitor advise on the issue where he recommended flr-fp base on the current situation. So I go ahead and apply for the flr-fp I'm which he said it would take 4 to 6 months.

Casa has said exactly what most of us would say.

It would have been simpler and less stressful if you had returned home and applied properly for a spouse visa.

FLR(FP) can take many months. All you can do is wait.

Definitely a lengthy process. I applied on 22nd of June and received approval on the 16th of January. Nothing you can really do but wait unfortunately. Some applications are quicker than others, but as previously mentioned some are a lot longer. Hope things work out for you.

Only you will know what evidence you may be able to find to prove you were living together during January & July.

Don't your children have any proof of address such as medical registration, child benefit etc?

Thanks for the reply.
It's to prove I was living at the particular address between jan-jul 2016 but because of Immigration status I have no letter documents coming in my name. Where the kids are concern they have most of the relevant proof such as child benefit and tenancy agreement with there names on it so I really don't know.

Many applicants, mostly FLR(FP) ones, get this letter. Some are approved, some are refused. You will only know when you go to the appointment.

Hello, that's good news that you have received a letter, again, it's a decision letter and you can choose to take a representative with you.

It's verification of ID and the decision given to you. Other members have posted their experiences with positive and negative decisions.

At least you will know WHAT to do after the decision, approval or no approval, there will be always something for you to do/appeal or have a decision. After a 9 month wait! I know it's very frustrating.

Please post your outcome, don't worry, have faith and have all your proofs with you as they have requested. Best of luck.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.
