Tier 2 to ILR advice please

Post by yorkdave » Sat Jan 21, 2017 8:46 pm

Hi All,

I am going to apply for ILR under 5 year route of Tier 2 (General) visa. For your information, I came to UK under Student Visa Category and switched to PSW, then Tier 2.

I have a doubt in filling the SET (O) form. In page 79, Section 12H, I will tick first two boxes and there is a statement as "For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules". Do I need to tick it? Is this question is relevant to me? Why there is such a question?

Thanks a lot

If for example you were combining time spent as a Tier 1 General migrant and a Tier 2 migrant to make up the 5 year period, you would need to show that you met the requirements of the immigration rules whilst you were a Tier 1 migrant. In your situation, because you have spent all 5 years as a Tier 2 migrant, this doesn't apply to you. Best wishes with the ILR application.

My Premium appointment is next week. your reply will be much helpful.

I have a question regarding 12H, I am applying under Tier 2 (General) 5 year route.

For the period before you were granted leave as a Tier 2 migrant, documents showing that
you met the relevant requirements of the immigration rules.

Student visa 21-sep-2008 to 23-Feb-2010
Tier1 (PSW) 23-Feb-2010 to 21-Feb-2012

Tier2(General) 21-Feb-2012 to 23-Feb-2015
Tier2(General) 21-Jan-2015 to 16-Feb-2018

Do I need to tick this or not! if I am applying under Tier 2 (General) 5 year route. if yes what documents do i need to provide.

Much appreciated for your reply.

Thanks in advance
