Maintenance Funds

Maintenance Funds

For the maintenance funds aspect, I wanted to know if it is necessary to show bank statements or showing it in any other form is also acceptable, for example, Fixed Deposit investement in bank, investments in stocks/share market worth 800 pounds as these are liquid assets?

I also need some clarification in this regard. Does the £800 minimum fund have to be in the main applicants account or can any family members' account funds will also be acceptable? We have sufficient funds in account which is in my wife's name who is my dependent on HSMP. Shall funds from my wife's account be acceptable for the purposes of maintenance funds in the newsystem? Or shall I transfer enough amount into our joint account which, ofcourse, has my name also.

Please answer urgently as I have too less time left to apply for FLR..Thanks

You need £800 (For main applicant) + £533 (Dependent) or you can show£800+533 in your account for past one months if you apply before 29th june .. no need to show last 3 months . Read Tier1genpolicyguide from Official site .. Here is the extract
Transitional arrangements for maintenance (funds)
Normally, when applying to Tier 1 (General) from within the United Kingdom,
you will have to show that you have enough funds, by sending documentation
showing you have had savings of at least £800 for at least three months
before applying.
Because this is a new requirement and it may be difficult to prove this
immediately, we have put transitional arrangements in place for applicants
and their family members submitting their applications within the United
Kingdom up to and including 29 June 2008.
Up to 29 June 2008, you do not have to show you have had the funds for at
least three months before your application. You must only show you have the
required funds at the time you apply. The types of documents you need to
send to support your application are detailed on p21 of this document. Until 29
June 2008, they do not need to cover the three-month period, but they must
be dated no more than a month before your application.
For example, if you apply under Tier 1 (General) on 12 June 2008, a single
bank statement with a closing balance of £800 dated between 12 May 2008
and 12 June 2008 will meet the maintenance requirements. A bank statement
dated before 12 May 2008 will not be acceptable.
For applications submitted within the United Kingdom on or after 30 June
2008, you will have to meet the requirements detailed on p21 of this guidance
document.

Hi

Thanks for the detailed answer. however my previous question remains unanswered. Can one use bank or building society statements in their dependents (eg, wife's bank account) name towards fulfilling the maintenance funds requirement? Will it be acceptable or the statement has to bear the main applicants name?

Thanks ash20 for the reply, however this does not answer my question that if I have to necessarility show the funds in a bank account or other liquid asset statements will do.

From the extract you have pasted, it seems that they need only bank account statements. I guess I will need to contact the HO directly and confirm this with them.

Ok, this is what maintenance section J says

Please provide evidence that the dependant has access to available funds in order to support themselves. Funds may be
in the name of the dependant or the main applicant. Please tick the relevant boxes to indicate the evidence supplied.


I guess that answers the question ... Main applicant should be fine .. but there is one more catch .. i happen to read yesterday . read this before u apply

The level of funds the dependant must have access to depends on the length of time the main applicant has been in the
UK.
Please confirm whether, at the time of the dependant application, the main applicant has been in the UK for:
Less than 12 months- please provide evidence that they have £1600 available funds; or
12 months and over - please provide evidence that they have £533 available funds.


I recommend to call them before you apply which i am going to do on Monday :-)

In relation to people apply after the 28 June the guidelines state that..........
MAINTENANCE (Funds)
Maintenance Requirement – All Applications
188. Please refer to paragraphs 245B of the Immigration Rules.

190. In order to qualify for leave to remain under Tier 1 an
applicant must demonstrate that they have sufficient funds of
at least £800 personal savings to support themselves.

Documentary Requirements

1. Personal bank or building society statements covering the
3 month period immediately preceding the application.
The personal bank or building society statements should
clearly show:
• the applicant’s name;
• the account number;
• the date of the statement;
• the financial institution’s name and logo;
• transactions covering the three month period;
• that there are sufficient funds present in the account
i.e. the balance must always be at least £800;
• the receipt of funds along with regular withdrawals from
the account, where appropriate.
Reading this my interpretation is that the HO is expecting applicants current account to be in credit by £800 for the required period. My savings bank account does not have regular withdrawals..........what other account could they mean!

This is only my interpretation and would appreciate any insight from a senior member.
