Need advice. 14 years concession

Hi,

My aunt and her family came to uk about 12 years ago on a visitor visa. She has a brother and 2 sisters who are both British Nationals.
My aunt children are now aged 17, 21 , 22. all of them are studying. one of them is studying medicine, other has got a scholarship at private school and is studying A levels while the third one has a part time job and is alsoat uni. they originally came here on visitor visa but intended to apply for asylum but didn't after advice. my aunt husband had passed away and due to a feud between families in which her brother was killed, they came here. Originally family members here looked after them for the first two years after which my aunt started to work part time. She did this for two years or so but after falling ill she has never returned to work and ever since has lived on benfits. Two of her children have large student loans. what are there chances of getting long term concession.

I would be grateful for any replies. Thanks

There is a very high chance of qualifying for the 14 year long residence concession.

You need to have sufficient evidence to prove that 'they' have rsided in the UK fopr each of the last 14 yeras.

Only make an apllication after your friend has been in the UK for 14 years + 1 day.

She did this for two years or so but after falling ill she has never returned to work and ever since has lived on benfits. <== benefits on a visitor visa ??? :shock: :shock:

she managed to take advantage of a loop hole and managed to get ILR. by going to EU country without a visa but on the way back she was given ILR. But her children don't have this.

What loop hole is this? if at all it exists.

Are you sure it is ILR or mere LTR assuming your Auntie is from one of the ne EU countries (the Accession Countries)

its not a loop hole in a sense. it was more of taking advantage of a weakness in immigration controls which she came to know through someone. this allowed her to get ILR. It does not work any more.

It appears that as a minimum there was misrepresentation of material facts or impersonation at the relevant port of entry for endorsment of a settlement stamp. Such makes your relative an illegal immigrant liable for removal as well as impacting on the character requirement for both 10 and 14 year long residence categories as well intended naturalisation if any for British Citizenship.

but in the first case, by living here for 14 years, are you not showing improper character( i mean, that is what is illegal is all about).
