Irish Citizenship Question - Mother has Irish Passport

Irish Citizenship Question - Mother has Irish Passport

Hi,

I am an Australian and my mother holds an Irish Passport (her grandmother was Irish born). She obtained her passport after I was born.

Do I qualify for Irish Citizenship? Should I find a lawyer or immigration specialist concerning this?

Any help would be appreciated.

Unfortunatly no you are definatly not entitled to Irish citizenship. It ended with youre mother. I was in the exact same position and had to get citizenship through naturalisation.There would be no point obtaining the services of a lawyer as he/she will tell you exactly what I have.

First ... are you sure it was through her grandmother? Could it have been her mother? It makes a difference.


If it was via grandmother, it's not when she obtained her passport that matters. It is when she obtained her Irish citizenship by Foreign Birth Registration (FBR).

What date is on her FBR certificate? If it's before you were born OR before 1987 you may have a chance.

Also, if it was before 4 April 2002, she may well no longer be an Australian citizen, again depending on the dates you give.

Since 1 July 1986, a person registered in the Foreign Births Entry Book after 1986 is deemed to be an Irish citizen only from the date of his/her entry in the Register and not from the date of birth. This means that children born to that person before his/her date of entry in the Register are not entitled to citizenship.

People registered before July 1986 are deemed Irish citizens either from the date the original Irish Nationality and Citizenship Act came into force, that is, 17 July 1956, or their date of birth, whichever is later. Only children born after 17 July 1956 can claim citizenship in such cases.

01. Do they ever consider waivers for the that 1986 date?

02. Has anything ever come of this rule chage idea?

It means three things:

1. If she was aged 18 or over on that date, she lost her Australian citizenship. Before 4 April 2002, acquisition of a foreign citizenship by a voluntary act in general caused loss of Australian citizenship.


Has she travelled outside Australia since then? (without a Resident Return Visa) If so, she has an unlawful non-citizen upon her return as her Australian passport is invalid.

The better news is that she can apply for resumption of her Australian citizenship.



2. Assuming you were born before 1988, you are not eligible for Irish citizenship because she registered in 1988, which is after 1986. Sorry - no waivers.


3. Children could lose Australian citizenship when a parent did. Probably that didn't apply to you, as long as your father was an Australian citizen - was he?
