Eligibility to apply for british passport /settlement?

Hi,
Here is the scencrio:

Mom of XYZ has a british passport. She has the name of her XYZ daughter in her first passport but not in the second passport (renewed lately). XYZ is a married woman with kids. Is XYZ also eligible to apply for the UK immigration/passport/settlement on the basis on her name on her moms first passports?


I 'd appreciate if anybody can answer to the above query.

It doesn't have to do as much with name appearing on the passports as with the fact of the mother-daughter relation. The proof of such relation can be various, it doesn't have to be their passports.

Thanks for the response. So what do you suggest as the starting point to find out if she can apply for passport/immigration/settlement ? If she can prove that she is the daughter , not living in UK though, then whats the law on this point ?

I obviously am not familiar with all the angles of the situation, but general rules are simple: she can join her mother to live in the UK if she is under 18, and cannot if she is over 18 (unless she has "compassionate circumstances").

My honourable friend,

We do not know where and when xyz was born
We do not know the nationality of xyz’s mother when xyz was born
We do not know how the mother has become British
We do not know on what basis xyz has been added to her mother’s British passport

However, in answer to your quiz xyz can not apply for settlement visa under the immigration rules 297 or 301 because she is leading an independent life as you have stated.

If xyz was a British citizen long time ago, this is a different issue.

Please review the following chart for a possible solution to your quiz in respect of xyz’s nationality.
