Need Help with Codes of Practice occupation

Hi all,

My application is refused on 5th Feb 2010 was applied on 17/11/2009. the reason is my employer has offered my £20000 salary as MIS Manager and it was requirment if i have the bechlour degree. but now on the refusal letter they said it should be £44700 per year. i checked with the Codes of Ptactice occupation on the UKBA website but it was updated on the 30/11/2009.

and yes my friend working with me has applied for IT Manager with the same salary £20000 per year and, we both applied at the same time and he got his visa before christmas.

Has anyone got the Codes of Practice occupation List before 30/11/2009.

1. I do not think so that anybody will be able to give u that (the previous list).
2. If u friend got the visa then ask him plus if you are going to appeal then mention that in u cover letter that u both applied at the same time and he got the visa and you did not.
3. U said that u applied under " MIS MANAGER" and your friend applied under " IT MANAGER" so there are two different titles.
4. Also r u saying that if you both applied at the same time for the same job so that means that u company needs to people doing the same job.
5. Somthing not right about u post so clear the confusion.

there were 2 deffrent positions 1. MIS Manger and 2. IT Manager and we applied as we were already working for the company since long time, i meant to say was if you look at the list those 2 positions are in the same code 1136 (Imformation and Communication)

1. Yes thats correct and the wages are £44700.
2. Did u make sure that u used the correct code and u employer also issued the COS with the correct code.
3. If the correct code was used then u shud appeal and give reference of your friends case.
4. If you can prove u point then u shud win the appeal but according to my understanding even if the list was updated then it can not be a difference of £24700 between the two lists straight away.
5. So go for the appeal (if u were given the right) and prove u point.

1. Is u visa expired now or u still hav valid leave from u previous visa?

2. U were not given any right of appeal as u still have a valid leave untill march.
3. HO does not give a right of appeal to anybody who still has a valid leave after the refusal.

My wife is 6 months pregnant, can we get temporary extenstion untill the baby get delivered?

So you have any idea for this?

1. I do not think so that u will be able to do that as u can only apply for extensions and not temporary leave.

I have copies of the previous codes of practice and I can confirm that the MIS/IT Manager role has required a salary of £44,700 since 2008 - all the updates in 2009 had the same minimum salary requirement. In 2007 the requirement was a salary between £43,000 and £60,000.

Therefore, if you appeal on this basis you are not going to succeed as it's never been a minimum of £20,000.

If you friend is working in an IT Manager role for £20,000 then the UK Border Agency has been mislead by your friend and your employer - alternatively, perhaps you do not know the full details of their visa status and what they are actually being paid.
