dependent visa refused - advice needed

Post by jituce » Sat Oct 23, 2010 7:34 am

Hi

I am on IcT Visa tier 2 and leagal Worker,
I have applied of my wife's dependent visa
and It is refused on the ground that
you have provided no evidence that you have any

contact with main applicant since, your

marriage.Futher more your partner travelled from

india on 16/01/2010 and he has not returned to

india since.

This is strange , I have submitted valid

marriage certificate.

Can you please advice , what I can do now ?
Can I go for apeal , this I suppose takes long

time.

Is there any other fast ways to get my wife in

uk ?

When main migrant and dependent (spouse) have recently married or have lived apart for a significant time (e.g. - main migrant overseas and dependent in home country), evidence(s) to prove that the relationship is subsisting reduces / eliminates the risk of application refusal.

In your case, the refusal appears to be for lack of evidence(s) to prove a subsisting relationship. Evidence(s) to prove subsisting relationship may include emails, internet chat transcripts, phone bills detailing calls, money transfer etc.

Appeal can take months, so appeal only if you have the patience to wait. Else, apply again and include evidences as mentioned above to prove subsisting relationship.

It is for you to provide the evidence. If you wish to, you may use the services of a solicitor to apply for the dependent EC.

not much evidence

Post by jituce » Tue Oct 26, 2010 6:43 am

I came first time after my marriage in jan 2010. Unfortunately I don't have much evidence that I were contact with my wife as I was doing vedio chating . I called her by calling card (like white cards and chiili talk) , Also I was recently married that's why didin't had much joint evidence. My wife was using my bank account so there are no records of money transfer.

Normally how much time appeal will take in such case ? I heard that they don't take appeal as priority and took almost more than year.

Unless you address the issue, future applications may be refused for the same reason.

Appeal can take months to be decided.

And, please don't make multiple posts on the same topic.
